BARBARA OLSHANSKY (USA) Barbara Olshansky is the Assistant Legal Director of the Center for Constitutional Rights since 1995. She is one of the lawyers who prepared the case concerning the illegality of the US detention activities in Guantanamo. She is the author of Secret Trials and Executions: Military Tribunals and the Threat to Democracy (2002), co-author of Against War in Iraq: An anti-War Primer (2003), and also co-author of America?s Disappeared: Secret Imprisonment Detainess and the ?War on Terror? (2004).

Abstract: Covert Practices in the U.S. War on Terror and the Implications for International Law: The Guantanamo Example by Barbara Olshansky This presentation will cover the range of legal and political measures employed by the U.S. government in the "global war on terror" both within the United States and outside. The presentation will include a discussion of anti-immigrant measures, enemy combatant status, detentions around the world, and the treatment of detainees, with a special focus on the Guantanamo Example.

Collective Punishment

Different crimes were and are being committing against Iraq and Iraqis by the occupying American forces but I will concentrate on Falluja.. I am speaking as a journalist and as a person from Falluja. I am an eyewitness of the two strikes against Falluja in April and November 2004. In the first massacre 518 civilians were killed among them, according to Dr Ahmed Hardan of the Falluja General Hospital, were 216 children who were killed either by the Americans or because of the lack of food and drinking water while the town was under siege. The first massacre began on April 4th 04 till May 1st. I could never forget the killing of 25 members of two families gathered in one house in Goulan area; this crime happened on April 11 04.
In the second massacre began on November 1st, not on Nov 8th as the Americans said. Their pretext was the Allawi Cabinet asked their help. Days before the strike, flayers were distributed asking the people to stay at homes otherwise they would face dander.. 150 000 from 600 00 stayed in the town. Those who stayed were surprised when the bombing targeted the houses first. I saw the women, children and elderly people were running fear of bombing here and there.
On Nov 15th, in Goulan area, 20-25 persons were running barefooted when an American warplane bombed killing and wounding them; only one elderly woman and 2 children stayed safe when they did hide themselves under rubbles of a bombed house. The dead bodies were left in the street for 20 days; because of the lack of the first aids, most wounded died.
Let me speak about Sua'ad Salam who stayed in a bombed house with the dead bodies of her whole family in Hasawa area, central Falluja.
The American forces considered the whole Falluja as a military target without taking in the consideration the humanitarian issues; they destroyed the town 100%; they destroyed the houses and infrastructures.
I think that the all remember the TV images of killing an unarmed wounded young man; that was on Nov 14th, in Hussein Shalash mosque in Al Shuhada area, south Falluja.. may be no body knows that the same American soldier with the same gun killed three others.
On Nov 25th, 15 American soldiers a house at Bathara area, central Falluja, three civilian men were there; one was handicapped, the second 61 years old and the third was 52 years old. The only one who stayed alive said, "When the Americans entered the house they saw that we were sitting unarmed; 14 left and the last one threw us a grenade saying -bye-. Two were seriously wounded I with my slight wounds tried to help them but after a while they were back; I pretended dead while the other two were suffering. They put a bullet in every head and left.
Whatever, the stories need volumes to be said; but what I want to add is the doctors and the staff of the Falluja hospital was detained on Nov 15th; the warplanes bombed the alternative hospital in downtown the town; bombed the medicines warehouses in Nazzal area; killed 4 doctors, 8 medical workers.
According to the numbers of the Association of the Moslem Scholars: 3500 civilians were killed, 7000 were wounded, and 1200 were arrested. 45 days after the massacre, the people began returning; the civil society organizations arranged an accurate body counting according to the sources of the hospital, mosques and official offices; the killed were 4000, wounded 7000.
Before ending my testimony, I should speak about an old woman, 71 years old, who died because of lack of her medicine; even before her martyrdom she asked me to take her condition to the Iraqi ministry of health and international organizations because she could not find her medicines when Falluja under siege. Also allow me mention Awwad Mohammed Al Dulaimi who lost his whole family, first wife, 5 sons, 2 daughters, a daughter in law and 2 grandchildren 6 months and 5 years old. His second wife is still surviving but blind and he had a heart attack. This happened on October 2nd 04.

The American Soldier are arresting and Keeping Iraqi Children as pawns
Baghdad. The American occupation army has, today, arrested five children who are under the age of ten, and kept them as pawns in the Iraqi city of Baji. They are intending to keep them until the city inhabitants turn over the children who were shown on TV screens, in the beginning of this week, demonstrating and holding the clothes of American soldiers killed lately in the city centre by a roadside bomb. According to a Baji police source, the American forces have encircled the city and arrested the children, and in the meantime they were urging the public via loud speakers to turnover the wanted children: According to the same source, the American army has threatened that they would storm the city and begin a campaign of house to house searching and arresting people if they wouldn’t turn the wanted children over to the Americans

Today, Pentagon officials have concluded it was a massive roadside bomb that killed 14 Marines in the western city of Haditha! Some people were astonished and surprised by the announcement of this news. Many of us have multiplied this number by 4. All people were correct with respect to their surprise and expectation. But where is the truth?! Why did the American Administration and the Pentagon officials go out now and acknowledge this big loss in one operation?! What’s next to this declaration which disappointed the American’s public opinion including those who were pro-Bush and those who were beating the drums of war?

The key answer for these questions is the people of Haditha who had witnessed the whole event or some of it. Here is what they had to say – yesterday- and their stories have been confirmed today by the American pronouncement.

Following the retreat of the American troops from the areas of Haditha and Haqlania as a result of a massive fire and brave assault by the Iraqi resistance forces, the American Marines have kidnapped some old men, a little girl and some men who were praying in nearby mosques and held them as hostages. The Americans have also observed the retreat and redeployment of the resistance fighter around the towns and behind the enemy lines. The defeated Marines have tried the day before yesterday to trap the resistance fighters in ambushes installed in places they expected the fighters would pass through. The best of the Marine’s engineering officers have participated in the installation of the ambushes. However, they did not know that they were being watched ever since they entered the area by the resistance reconnaissance. The resistance fighters then attacked the Marines and killed three and took ten of them as prisoners of war, five of them were engineering officers. The resistance fighters have released one wounded Marine soldier in order to let him go and inform his commanders – who were in the neighbouring area- that the fighters were ready to negotiate the release of the Americans if the Americans were ready to release the old men and the little girl from Haditha who were taken hostages by the retreated Marines.

The criminal Marines have answered the resistance fighter by a new attack using all kinds of weapons including helicopters and cannon boats in an attempt to surround the freedom fighters. The brave Iraqi freedom fighters responded to the attack and lost four of their comrades. They then retreated and took with them the ten American prisoners. The freedom fighter realised that the Americans forces did not respect or even tried to preserve the souls of the best of their officers and soldiers. They also remembered the crimes committed by the American forces and their intelligence against Iraqi prisoners of war a few months ago. Namely, the Americans have tortured and killed in cold blood some captured Iraqi resistance fighters and threw them in the river over the Haditha-Haqlania Bridge which is now call the martyr’s bridge. The Iraqi freedom fighter had then no choice but to kill the American prisoners of war and threw them in the river the same way as the Americans previously did -over the same bridge- just to remind them about the crimes they have committed against the Iraqi prisoners of war and to let them bear the responsible for the lost lives of their comrades as a result of their refusal to negotiate the terms for their safe release.

Now, what the American forces gonna do when most of their officers have already been informed about what had happened? The death of the ten American officers – who were considered to be some of the best-, could have been prevented. How would the American Administration stop or prevent the spread of this scandal among its forces? How would it cover up the killing of ten of its best officers which had occurred before the naked eyes of hundreds of Marines and inhabitants of Haditha and Haqlania? They were not mercenaries from Latin America, South East Asia or Africa, they were Americans?! Therefore, the criminal American Administration has chosen to announce about their death today, 36 hour after their killing! The faked story about their killing by a roadside bomb was designed to cover up the failure to save their lives. The next step expected to be taken by the American occupation force following this announcement is the commitment of a new war crime against the innocent civilians in Haditha and Haqlania as a cowardly vengeance act in order to deviate the attention of the mass media away from their failure and unwillingness in rescuing their colleagues.
